1. Acceptance of Terms
By accessing or using Whizly AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Whizly AI provides an AI-powered customer relationship management (CRM) platform that includes:
- WhatsApp integration and conversation management
- AI-powered call transcription and analysis
- Autonomous advertising campaign management
- Banking integration and smart accounting
- Lead scoring and customer analytics
- Multi-tenant CRM features
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and have the authority to enter into this agreement on behalf of your organization.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Subscription and Pricing
4.1 Fees
You agree to pay the subscription fees as specified in your plan ($19 per user per month, or as otherwise agreed). All fees are non-refundable except as required by law.
4.2 Billing
- Subscriptions are billed in advance on a monthly or annual basis
- Automatic renewal unless cancelled before the renewal date
- Price changes will be communicated 30 days in advance
5. Acceptable Use
You agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload malware, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Use the Service for spam or unsolicited communications
- Resell or redistribute the Service without permission
- Reverse engineer or decompile our software
6. Data and Privacy
6.1 Your Data
You retain ownership of all data you upload to the Service. You grant us a license to process your data solely to provide the Service.
6.2 AI Processing
By using AI features, you consent to the processing of your data by our AI systems (including OpenAI) for analysis, insights, and automation purposes. We implement PII sanitization before sending data to third-party AI services.
6.3 Third-Party Services
Our Service integrates with third-party platforms including but not limited to:
- Meta/Facebook: For advertising services, custom audiences, and conversion tracking via Meta Pixel
- OpenAI: For AI-powered conversation analysis and insights
- Google Cloud: For cloud infrastructure and storage
- WhatsApp (AiSensy): For customer messaging integration
- MyOperator: For call tracking and recording
- Razorpay: For payment processing
Your use of these integrated services is subject to their respective terms of service and privacy policies. By using our advertising features, you acknowledge that customer data may be shared with Meta/Facebook for custom audience targeting and ad optimization.

7. Service Level and Support
7.1 Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We will provide notice of scheduled maintenance.
7.2 Support
Email and phone support is provided during business hours (Monday-Friday, 9 AM - 6 PM IST).
8. Advertising Services
8.1 Campaign Creation and Management
Our AI-powered advertising features ("AutoAds") allow you to create and manage advertising campaigns on third-party platforms including Meta/Facebook and Instagram. You acknowledge that:
- You are responsible for all ad content, targeting, and budget decisions
- Ads must comply with the advertising policies of the target platform (e.g., Meta Advertising Standards)
- We are not responsible for ad approval, rejection, or account suspension by third-party platforms
- You must have the necessary rights and permissions to advertise products/services
- You are responsible for all advertising costs charged by third-party platforms
8.2 Custom Audiences and Data Sharing
When you use our advertising features to create custom audiences on Meta/Facebook:
- You warrant that you have obtained necessary consent to share customer data with Meta/Facebook
- Customer data (email addresses, phone numbers) will be hashed before transmission to Meta
- You are responsible for compliance with applicable privacy laws (GDPR, CCPA, etc.)
- You may opt-out customers from custom audience targeting at any time
- We implement privacy safeguards including Limited Data Use (LDU) mode for California users
8.3 Meta Pixel and Tracking
Our Service may use Meta Pixel to track website activity for advertising purposes. By using our Service:
- You consent to the use of Meta Pixel on our website (subject to your cookie preferences)
- Meta Pixel collects data about your website visits, actions, and device information
- This data is used to measure ad effectiveness, optimize campaigns, and create retargeting audiences
- You can opt-out of Meta Pixel tracking by declining marketing cookies in our cookie consent banner
- California users automatically receive Limited Data Use (LDU) mode protection
8.4 Advertising Credits and Billing
Advertising costs are billed separately through our unified credit system. You agree to:
- Maintain sufficient credits for advertising campaigns
- Accept responsibility for all API costs incurred through automated campaigns
- Review and approve campaign budgets before activation
9. Intellectual Property
9.1 Our Intellectual Property
All rights, title, and interest in the Service, including all software, designs, trademarks, and AI models, are owned by TRAFFILO HOSPITALITY LLP (Whizly AI). You may not use our intellectual property without permission.
9.2 Your Content and Ad Creative
You retain ownership of all content you create or upload, including:
- Customer data and CRM information
- Advertising copy, images, and creative assets
- Business information and proprietary data
By using our advertising features, you grant us a limited license to:
- Use AI to generate ad copy and creative suggestions based on your CRM data
- Transmit your advertising content to third-party platforms (Meta, Google, etc.)
- Store and process your content to provide the Service
This license terminates when you delete the content or close your account.
9.3 AI-Generated Content
Content generated by our AI features (ad copy, insights, recommendations) is provided as-is. You are responsible for reviewing, editing, and approving all AI-generated content before use. We do not warrant that AI-generated content is accurate, complete, or suitable for your specific needs.
10. Termination
10.1 By You
You may cancel your subscription at any time. Your access will continue until the end of your current billing period.
10.2 By Us
We may suspend or terminate your account if you violate these terms or engage in fraudulent activity.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIZLY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
12. Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13. Compliance with Advertising Standards
13.1 Platform Policies
When using our advertising features, you agree to comply with all applicable advertising standards and policies, including:
- Meta Advertising Standards: https://www.facebook.com/policies/ads
- Meta Community Standards: https://transparency.fb.com/policies/community-standards
- Google Ads Policies: (if applicable)
- All applicable laws and regulations governing advertising in your jurisdiction
13.2 Prohibited Ad Content
You may NOT use our advertising features to promote:
- Illegal products, services, or activities
- Discriminatory practices or hate speech
- Misleading, deceptive, or fraudulent claims
- Counterfeit goods or intellectual property violations
- Adult content, tobacco, weapons, or other restricted products
- Content that violates third-party rights
We reserve the right to suspend or terminate access to advertising features if you violate these policies.
13.3 Data Protection Compliance
You are responsible for ensuring your use of custom audiences and advertising features complies with:
- GDPR (General Data Protection Regulation) for EU/UK customers
- CCPA (California Consumer Privacy Act) for California customers
- India's Personal Data Protection laws
- Any other applicable privacy and data protection laws
You must obtain necessary consents before uploading customer data for advertising purposes.
14. Modifications to Terms
We reserve the right to modify these terms at any time. We will notify you of material changes at least 30 days before they take effect.
15. Governing Law
These terms are governed by the laws of India. Any disputes shall be resolved in the courts of Bengaluru, Karnataka, India.
